General terms and conditions of sale

ARTICLE 1: PURPOSE – SCOPE OF APPLICATION

 

These Terms and Conditions of Sale (T&Cs) apply, without restriction or reservation, to all Services offered by Iris Bazin to Clients.

Any Order implies the Client’s prior, express, and unconditional acceptance of these T&Cs, which prevail over any other document, unless otherwise agreed in writing with Iris Bazin.

Iris Bazin expressly reserves the right to modify these T&Cs at any time. However, for any Order, the applicable T&Cs are those in force at the time the Order is placed.

Terms beginning with a capital letter have the meaning given to them in Article 2 below.

ARTICLE 2: DEFINITIONS

Terms beginning with a capital letter shall have the meanings set out below:

  • “Gift Card”: a personal voucher granting the named individual access to one or more Services.

  • “T&Cs”: these Terms and Conditions of Sale.

  • “Client”: any non-professional individual placing an Order.

  • “Order”: any firm commitment entered into with Iris Bazin, whether for the purchase of a Package, a Gift Card, or the booking of a one-off Service.

  • “Package”: a bundled offer of Services.

  • “Iris Bazin”: the French sole proprietorship BAZIN IRIS, registered with the Paris Trade and Companies Register under number 942 193 731.

  • “Parties”: collectively and individually, Iris Bazin and a Client.

  • “Services”: collectively and individually, the services described in Article 3 below.

  • “Website”: the website https://www.irisbazindoula.com/

 

ARTICLE 3: SERVICES

1. Nature and scope of the Services

The Services are exclusively intended for well-being, listening, and emotional, relational, and personal support.

They do not in any way replace medical, psychological, or paramedical care and do not involve diagnosis, prescription, or any medical or therapeutic act.

Iris Bazin does not provide any diagnosis, prescribe any treatment, or perform any medical or paramedical act.

The Client remains solely responsible for decisions concerning their health and that of their child and is expressly encouraged to consult a healthcare professional for any medical questions.

 

2. Scope of Services

The Services offered, as described on the Website, include:

  • prenatal and postnatal support at the Client’s home;

  • presence at birth;

  • group workshops, in person or online;

  • Rebozo massages and treatments at home.

Services are provided at the Client’s home, at Espace Soon (18 rue Saint Ambroise, 75011 Paris), or exceptionally at Iris Bazin’s home.

3. Obligation of means

Iris Bazin is bound by an obligation of means and undertakes to perform the Services in accordance with professional standards, with due care, professionalism, availability, and diligence, in strict compliance with the Doulas de France Charter.

4. Information and exclusion

The Client agrees to:

  • inform Iris Bazin, at the time of the Order and before any Service, of any relevant information regarding their health or that of the child;

  • provide a suitable space for Services carried out at home;

  • respect scheduled appointments, in accordance with the cancellation conditions set out in these T&Cs.

Iris Bazin may refuse or interrupt a Service in case of contraindication, insufficient hygiene/safety conditions, or inappropriate behavior.

ARTICLE 4: ORDERS AND BOOKINGS

Orders are placed exclusively by phone or email:

Subject to the right of withdrawal described in Article 8 below, any Order is firm and final once the Client has expressly accepted these T&Cs.

Each Order will be confirmed by an email sent by Iris Bazin to the Client, including a summary of the Order and the T&Cs. The Client’s positive response constitutes full and unconditional acceptance of the T&Cs.

ARTICLE 5: PRICES AND PAYMENTS

1. Prices

Applicable prices are those indicated on the Website.

Prices are expressed in euros, all taxes included. Iris Bazin operates under the VAT exemption scheme (Article 293 B of the French Tax Code).

2. Payment terms

Payments are made by bank transfer or in cash:

  • For Packages:

    • 30% deposit upon Order

    • 30% after the second session

    • 40% after the final session

  • For individual sessions: payment is due at the end of the session

  • For Gift Cards: payment is due upon Order

3. Late or non-payment

Any late payment will automatically and without prior notice result in late payment interest equal to three (3) times the legal interest rate, plus a fixed compensation of forty (40) euros for recovery costs.

In the event of non-payment, after formal notice remaining unsuccessful for eight (8) days, all sums due shall become immediately payable, without prejudice to interest and recovery costs.

In case of non-payment, Iris Bazin may suspend ongoing Services.

ARTICLE 6: GIFT CARDS

1. Validity

Gift Cards are valid for twelve (12) months from the date of issue. After this period, they expire permanently and cannot be refunded or extended, except in duly justified cases of force majeure.

2. Conditions of use

Gift Cards are personal and may not be transferred to a third party without prior written consent from Iris Bazin.

3. Refunds

Subject to the right of withdrawal described in Article 8, Gift Cards are non-refundable.

The Client agrees to provide the beneficiary with these T&Cs, which are also available on the Website at any time.

ARTICLE 7: CANCELLATION AND RESCHEDULING

1. Cancellation by Iris Bazin

In the event of unavailability or force majeure preventing Iris Bazin from providing a Service, she will offer the Client a rescheduling at a later mutually agreed date.

If rescheduling is impossible or refused, all sums paid in advance for the relevant Service will be fully refunded within a maximum of fourteen (14) days, excluding any further compensation.

2. Cancellation by the Client – One-off Services

In case of cancellation of a one-off Service (individual session, group workshop):

  • cancellation notified more than forty-eight (48) hours before the appointment: full refund of any sums already paid;

  • cancellation notified less than forty-eight (48) hours before the appointment or no-show: the Service remains fully payable and no refund will be issued.

3. Cancellation by the Client – Packages

In case of cancellation of a Package:

  • if cancellation occurs before the Package has started, the Client is entitled to a full refund, subject to Article 8 (right of withdrawal);

  • if one or more Services included in the Package have already been performed, only the Services not yet performed will be refunded, on a pro rata basis, minus any management fees capped at 10% of the total Package price;

  • if cancellation occurs less than forty-eight (48) hours before the next scheduled Service, that Service remains fully payable, even if other unused Services are refunded on a pro rata basis.

4. Force majeure – Client

If the Client is unable to benefit from a Service due to duly justified force majeure (within the meaning of Article 1218 of the French Civil Code), Iris Bazin will offer a rescheduling free of charge. If rescheduling is not possible, the unperformed Service will be refunded, excluding any further compensation.

ARTICLE 8: RIGHT OF WITHDRAWAL

1. Principle

In accordance with Articles L.221-18 et seq. of the French Consumer Code, the Client has fourteen (14) days from the conclusion of the Order to exercise their right of withdrawal, without having to justify reasons or incur penalties.

2. Exceptions and effects

The right of withdrawal cannot be exercised:

  • for a Service fully performed before the end of the withdrawal period, provided that performance began with the Client’s prior express consent and express waiver of their right of withdrawal (Article L.221-28, 1°);

  • for a Gift Card that has already been used.

If the Order concerns a Package, Services already performed remain fully payable. In the event of valid withdrawal before full performance, amounts due are calculated on a pro rata basis.

3. Early performance before the end of the withdrawal period

At the Client’s express request, a Service may begin before the end of the fourteen (14)-day withdrawal period.

In this case (Article L.221-25):

  • the Client acknowledges that early performance reduces their right of withdrawal;

  • in the event of withdrawal before full completion, the Client must pay an amount proportional to the Services already provided;

  • if the Service is fully performed before the end of the period, the right of withdrawal is lost (Article L.221-28, 1°).

4. Practical terms

The Client notifies their withdrawal by an unambiguous declaration sent by email to contact@irisbazindoula.com or by post (legal details), preferably using the template form in the Annex.

Iris Bazin will refund the amounts due within fourteen (14) days of notification, using the same payment method as the Order, unless otherwise agreed.

For Packages, the refund applies only to the unperformed portion, minus any proportional amount due under Article L.221-25.

ARTICLE 9: PERSONAL DATA

Iris Bazin collects and processes personal data in compliance with Regulation (EU) 2016/679 (GDPR) and the French Data Protection Act.

The data collected (name, surname, phone number, email) are strictly necessary for managing Orders and Services. They are retained only for as long as necessary and are never shared with third parties without the Client’s consent.

In accordance with regulations, the Client has the right to access, rectify, erase, restrict, and object to the processing of their data by contacting: contact@irisbazindoula.com.

In case of unresolved issues, the Client may lodge a complaint with the CNIL (www.cnil.fr).

ARTICLE 10: INTELLECTUAL PROPERTY

All texts, content, logos, photographs, and materials appearing on the Website or provided to the Client as part of the Services are protected by intellectual property law and remain the exclusive property of Iris Bazin.

Any reproduction, representation, modification, publication, transmission, or adaptation, in whole or in part, without prior written authorization, is strictly prohibited and may constitute infringement under Articles L.335-2 et seq. of the French Intellectual Property Code.

ARTICLE 11: PARTIAL INVALIDITY

If any provision of these T&Cs is found to be invalid or unenforceable by law, regulation, or a final court decision, the remaining provisions shall remain fully valid and enforceable, provided that the overall balance and intent of the T&Cs are preserved.

ARTICLE 12: MEDIATION – APPLICABLE LAW – DISPUTES

1. Mediation

In accordance with Article L.612-1 of the French Consumer Code, any Client has the right to use a consumer mediator free of charge in the event of a dispute.

The Client must first attempt to resolve the dispute directly with Iris Bazin through a written complaint.

2. Applicable law

These T&Cs and the resulting Services are governed by French law.

3. Jurisdiction

Any dispute not resolved amicably shall be submitted to the competent courts in accordance with the French Code of Civil Procedure.

ANNEX – MODEL WITHDRAWAL FORM
